Transfer of Undertakings (TUPE)

Transfer of Undertakings (Protection of Employment) Regulations (TUPE) apply when a part or the whole of an organisation is transferred to another employer within the UK, regardless of the size of the organisation. They are used more and more as organisations restructure in response to new challenges.

The process can be complex and challenging. Organisations are required to consult with their employees about the process, whilst in the public sector Transfer Orders and COSOP can apply. The regulations aim to protect employees’ terms and conditions agreed under the old employer, including pay, holiday leave, continuity of service date and sick pay.
